Terms of Service
1. Agreement
These Terms of Service ("Terms") govern your use of the BuildQC application and website (the "Service"), operated by Moyer Software ("we," "us"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.
2. The Service
BuildQC provides digital quality-control checklists for construction projects, including checklist templates, task assignment, photo documentation, electronic sign-off, approval workflows, QR-coded locations, and PDF report generation.
3. Accounts
- You must provide accurate information when registering and keep your credentials confidential. You are responsible for all activity under your account.
- Roles (Subcontractor, General Contractor, Admin) control what data you can see and change. Admins are responsible for assigning roles appropriately within their organization.
- We may suspend or terminate accounts that violate these Terms or misuse the Service.
4. Your Content
Checklists, templates, locations, photos, signatures, and reports you create ("Content") belong to you or your organization. You grant us a limited license to store, process, and display that Content solely to operate the Service. You are responsible for having the right to upload the Content you submit, including photos taken on job sites.
5. Acceptable Use
You agree not to misuse the Service, including by attempting to access data belonging to other organizations, interfering with the Service's operation, uploading unlawful content, or using the Service to violate any law or the rights of others.
6. Not a Substitute for Professional Judgment
BuildQC is a documentation and workflow tool. Checklists, sign-offs, and reports generated through the Service do not constitute engineering advice, code-compliance certification, or a professional inspection, and do not replace inspections or approvals required by law, regulation, contract, or building authority. You remain solely responsible for the quality, safety, and legal compliance of your construction work.
7. Availability and Changes
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. We recommend downloading PDF reports for records you need to retain.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law, Moyer Software will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim arose, or one hundred U.S. dollars, whichever is greater.
10. Termination
You may stop using the Service at any time. Upon account deletion, your access to Content through the Service ends; see the Privacy Policy for how data is handled after deletion.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be indicated by updating the effective date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
